Leaving a gift in their Will is one of the most meaningful and lasting ways your client can support the animals of RSPCA NSW.

Legacy gifts to RSPCA NSW honour the bond between people and animals, we work with executors and solicitors to ensure every bequest is managed with care and integrity.

Suggested Wording for Wills

We suggest the following wording be used in the drafting of your clients Will. Please ensure the wording includes RSPCA NSW. 

I give to The Royal Society for the Prevention of Cruelty to Animals, New South Wales (‘RSPCA NSW’)(ABN 87 000 001 641)

  • The rest and residue of my Estate; or
  • _____________ percent of my Estate; or
  • _____________ percent of the residue of my Estate; or
  • Share of my Estate; or
  • The sum of $_____________

free of all duties and testamentary expenses for its general purposes and I direct that the receipt of that organisation shall be sufficient discharge to my executors for this bequest.

I declare that the receipt of the Treasurer or a Proper Officer of the Society authorised to act on his/her behalf shall be sufficient discharge to my executors/trustees. 

Type of gifts that can be left to RSPCA NSW

There are several different ways your client can include RSPCA NSW in their Will. Executors should obtain independent legal, financial, or tax advice where appropriate.

Pecuniary Gift – A pecuniary gift is a specified dollar amount left to RSPCA NSW under a Will.

Percentage Gift – A percentage gift leaves a defined proportion of the estate to RSPCA NSW. This approach allows the value of the gift to rise or fall in line with the final estate value.

Residual Gift – A residual gift is a gift of all or part of the estate residue, after payment of debts, expenses, and any specific gifts.

Gift of Property or Assets – A Will may provide for the gift of specific assets, such as real property, shares, or other investments.

Gifts with Specific Directions – Some Wills include directions or conditions as to how a gift is to be applied. RSPCA NSW will consider the testator’s intentions in accordance with legal requirements and organisational policy. Early discussion is recommended where a gift is subject to restrictions.

Does your client have pets?

Pets are cherished family members, and it’s important to safeguard their future. Having a plan in place provides great peace of mind and secures the future wellbeing of a pet should its owner pass away or enter palliative care. Family and friends are always the best option, but for some, that option is not available; that’s where RSPCA NSW can help. The Home Ever After program (HEA) is a trusted, tailor-made future care plan for beloved pets, should they ever need it.

There is no charge during your client’s lifetime, this program is free for those animal lovers who kindly leave a gift in their Will to RSPCA NSW to help continue this and other life-saving programs.

What documents does RSPCA NSW need when notified of an estate?
  • Pecuniary or specific gifts: Copy of the Probated Will
  • Residual or percentage gifts: Grant of Probate, including the Will and Inventory of Assets and Liabilities.

Gifts are administered in accordance with applicable legal requirements, with due regard to the testator’s intentions and RSPCA NSW policies.

Yes, RSPCA NSW can accept gifts from overseas estates. Executors are encouraged to contact our Estates team early so that any jurisdictional or tax considerations can be reviewed prior to distribution.

Yes. Copies may be provided by email. Original documents will be requested if required.

RSPCA NSW does not publish bank details online. Official details are provided on RSPCA NSW letterhead upon request and should be verified by phone before payment.

Security Notice: RSPCA NSW will never provide banking details or payment instructions by unsolicited email. Executors should always verify banking details directly with the Estates team before making any payment.

If the Will includes provisions related to RSPCA NSW and/or the pet(s), these will be applied in accordance with the estate.

Where a Will provides for the care of companion animals through RSPCA NSW, We manage their care and rehoming in accordance with the terms of the Will and organisational policy.

Yes. RSPCA NSW may accept in-specie transfer of shares (i.e., transferring shares without selling them first) This is assessed on a case-by-case basis. Executors should seek independent financial or tax advice.
