Terms and Conditions

By submitting this form I certify and accept the following:
1.I hereby certify that I am duly authorised by the Council to seek acceptance of the above animal to the RSPCA NSW Shelter to meet the obligations contained within s34B of the Companion Animals Act 1998 (NSW).
2. I acknowledge and consent to the following:
  1. The animal I have described in this form is available for collection from today.
  2. The council and pound facility undertakes not to euthanise the animal described in this form within 7 days of the submission of this form.
  3. The council and pound facility will notify RSPCA NSW immediately if the animal is returned to its owner, transferred to other approved rehoming organisation, adopted, sold or otherwise rehomed.
  4. Where no response is received from RSPCA NSW within the seven-day holding period, the Council and pound facility shall proceed on the basis that RSPCA NSW does not have capacity to accept the animal.
3. In respect of any animal sought to be transferred to RSPCA NSW for rehoming, the council and pound facility shall make the animal available for inspection by RSPCA NSW staff to assess the animal. That assessment will:
  1. Relate to the animals’ veterinary and behavioural prognosis
  2. Identify any barriers to successful rehoming
4. Rehoming fee payable:
  1. Upon acceptance of the animal, the council agrees to pay a rehoming fee to cover RSPCA NSW expenses in performing health checks, microchipping, desexing, and making available for adoption.
  2. The rehoming fee will be determined at the sole discretion of RSPCA NSW and will be not more than $299.00.
  3. The rehoming fee will be payable on 7-day terms following receipt of an invoice in respect of the animal from RSPCA NSW.
5. The above details have been provided to the best of the staff members knowledge, having made reasonable inquiries as to the accuracy of its contents.
6. Indemnity:
  1. The council indemnifies, and keeps RSPCA NSW indemnified, against all loss or damage incurred or suffered in whole or in part by RSPCA NSW as a result of RSPCA NSW accepting the animal for rehoming. The indemnity extends to error contained in the information provided by the Council under this agreement or any negligent act or omission on the part of the Council.
7. Confidentiality:
  1. The council agrees to keep confidential the terms of this agreement.
  2. Where a party receives confidential information from the other party in accordance with this agreement, the Recipient must keep the Information confidential.
8. Privacy and GIPA:
  1. Each party will comply with its obligations under the Privacy Act 1988 (Cth), including without limitation its obligations in respect of any actual or suspected Data Breach. Each party will notify the other in writing as soon as possible, and in any event within 24 hours if it intends to notify any relevant regulator or impacted individual of an actual or suspected Data Breach.
  2. Each party will notify the other as soon as practicable if a relevant application is received pursuant to the Government Information (Public Access) Act 2009 (GIPA Act). Before making a determination in accordance with Part 4 of the GIPA Act the parties will consult each in order to determine whether there is an overriding public interest against disclosure of the information.
